Yes. I am talking about entirely new applications. Any pointers on that? And what would be the best way to track any developments about it?

as far as i know.. most of the companies are not filing any new GC applications.. specially those who have laied off people and by now most of them.
if you are really lucky and if your company is filing.. u may go through.. but still for labour itself now a days it takes i think aroung 8 - 12 months..

better option is you can file your own green card.. self sponcered.. then you do not have to depend on any employer.. u can change jobs.. u can get laied off without affecting your GC Provessing.. but u are taking about 10 K total expense may be.. u can hire a lawyer and do it all by your own.. which will go through eventually..

specially since with new rule.. once you get your labour certificate clear, u can apply i 140 and i 495 at the same time with ead and you are free to do anything.. after that..

Thanks Samir for info. Thing is, company really wants to file, but DOL is not accepting any applications for IT. So I just wanted to check if anyone here knew about specific decision by DOL. Thanks all for info. :-)

The reason is economy is going down.. there are so many american people without job already in this country.. and then it's not justified to hire a foreign persoon for something where lots and lots of people are already sitting job less.. so INS is asking companies to employee these people instead of getting new people in and detorating condition.. which makes quite sence.

FP zalya nantar sadharan kiti divasat GC approve hote? te jhalyanantar (GC approve) actually hatat padayala kiti kalavadhi jato sadharan? he kuni anubhavi sangu shaktil ka?

Storvi: thats not the case as of today.

Sadhya FP jhaalyavar it can take anywhere from 1 yr to 1.5 years to get ur I-485 approval.
Check timings here

Tu dileli link "adjudication" cha total time dakhavte which is a little misleading. I understand Bandakhor is asking about time "after FP".

We did our FP before scheduled date. However, our case got transferred from VSC to TX. When I talked with INS officer, he said that TX waiting time is 3 years 4 months. So we presumed it will be a longggg time. However, we got interview call within 3 months and case was adjudicated immediately. We were told it would be 1 month to receive plastic card, but were told to give them a call after 3 months in case cards were not received. However, it took us 2 followup calls & about 6 months. (The reason was files were transferred to VSC, but cards were not ordered by INS) We got the cards within 10 days after the phone call.

Upashobhika: can u please specify ur dates of I-485 filing, FP scheduled date and the date of approval, if u dont mind.

I got following when I checked on INS website online regarding a I-485 case processing...

Notice Date: 06/29/2001
FP was scheduled sometime in Nov.2001 but did in Oct.2001
Case transferred on 2/14/2002
Interview, approval & stamping: April 2002
cards ordered 10/8/2002
cards received 10/17/2002

bandakhor, to keep the GC valid you have to return to US before six months of out of country stay. I think you have to file the taxes here so you have to show that you are working here. One of my friends did these six months trips twice and now they decided to stay here. Also if you are thinking to apply for citizenship, you are required to stay here for a specific # of month before u can apply. (varies depending on the state) Hope this info helps.

Adjustment of status file करुन ६ महिने झाल्यानन्तर ( I140 approved and valid EAD ) कोणि job change केला आहे का? Labor file झलेल्या state मधुन दुसर्या state मधे job घेने allowed आहे का? H1 transfer सुद्ढा करावा लगतो का? कोनते papers आपल्याला आणि नविन company ला file करावे लगातत? Job change करन्याने green card process वर परिणाम होउ शकतो का?
कुनाला अनुभव / माहिति असल्यास Pls share.

Hello MPT ,
१८० दिवसांनतर जॉब चेंज करु शकतो. शक्यतो नवीन job responsibilties ह्या सध्याच्या जॉबशी similar असतील हे बघावे. if possible check with the immigration attorneys at your prospective new job to see if both jobs are similar. It is advisable to transfer H1B to keep underlying status active until your Permanent Residency is approved
